This Site is operated by Friend MTS Limited, a company registered in England and Wales under company registration number 03513618, with its registered office at 177 Shaftesbury Avenue, London, England, WC2H 8JR (“Friend MTS”, “FMTS”, “we”, “us”, “our”).
These Terms govern your access to and use of the Site only. They do not apply to any paid, contracted or subscription services that we provide. If you order any services from us, separate terms and conditions (including, where applicable, a Master Services Agreement or Subscription Agreement) will apply. In the event of any conflict between these Terms and any such agreement, the terms of the relevant service agreement shall prevail.
By accessing or using the Site, you agree to be bound by these Terms, as well as our Privacy Policy, Acceptable Use Policy, and Cookie Policy, which are hereby incorporated into these Terms. You are responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms and comply with them. If you do not agree to these Terms, you must stop using the Site immediately.
We may amend these Terms from time to time. Each time you use the Site, please review the Terms to ensure you understand the terms that apply at that time. Your continued use of the Site after any changes constitutes your acceptance of those changes.

2. How We Operate the Site

We may suspend or terminate your access to the Site if, in our reasonable opinion, you breach these Terms, our policies, or any applicable law, or if we detect suspicious, unauthorised or harmful activity.
4. Viruses and Unauthorised Activity

This clause constitutes an express reservation of all our applicable intellectual property and database rights. This clause does not apply where we are legally prohibited from restricting such activity by contract.

If defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
Different limitations of liability will apply to the liability arising as a result of the supply of any services to you, which will be set out in out in the applicable terms and conditions for the supply of those services.

If you are a consumer, these Terms of services, their subject matter and their formation, are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales, except that residents of Northern Ireland or Scotland may bring proceedings in their local courts.
If you are a business user, these Terms and any disputes (including non‑contractual disputes) are governed exclusively by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions shall continue in full force.

“Friend MTS”, “ASiD”, and associated marks are trademarks or registered trademarks of Friend MTS Limited, Friend for Media Limited, or their affiliates. All other brands or trademarks appearing on the Site belong to their respective owners. Unauthorised use of these marks is prohibited and may constitute a breach under the applicable laws.
